Special law to ensure the return of students in class – Provisions of the Act violate the Charter of Rights and Freedoms, according to the Commission on Human Rights and Youth Rights
“The Commission therefore concludes that Articles 12 to 31 of the Act directly or indirectly infringe fundamental freedoms, or freedoms of conscience, opinion, expression, peaceful assembly and association guaranteed by the Charter. These sections of the Act do not meet the test of justification derived from the jurisprudence of the Supreme Court pursuant to Article 9.1 of the Charter.”
